1. AUCTION DATE & TIME
This will be an online-only real estate auction. The auction will start to close on Thursday September 24, 2026 at 10:00 AM.
2. AUCTION METHOD
The property consists of Black Hawk County Parcel Nos. 901410426001 and 901410426003 and will be offered together as one tract. The parcels will not be offered separately.
Property consists of 29 acres m/l per assessor information and FSA maps. The successful bid price per acre will be multiplied by 29 acres to determine the final bid amount.
3. SELLER APPROVAL
The sale is subject to Seller's approval of the final bid amount. Seller reserves the right to accept or reject the final bid.
4. BUYER'S PREMIUM
A 10% Buyer's Premium will be added to the final bid amount to determine the total purchase price.
5. EARNEST MONEY
The 10% Buyer's Premium will be held as non-refundable earnest money upon acceptance of the successful bid and will be credited toward the total purchase price at closing.
The successful bidder will be required to execute a Real Estate Purchase Agreement following acceptance of the final bid.
6. FINANCING
The sale is not contingent upon financing. Buyers are responsible for making all necessary financial arrangements prior to bidding.
7. CLOSING
Closing shall take place on or before 30 days following the auction date, unless otherwise agreed upon by Buyer and Seller.
The balance of the purchase price will be due in full at closing.
8. POSSESSION
Possession will be given to the Buyer at closing.
9. REAL ESTATE TAXES
Real estate taxes will be prorated to the date of closing.
10. PROPERTY CONDITION
The real estate is being sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied.
An abandoned dwelling is located on the property and is considered unsafe and in need of demolition. Prospective buyers are advised not to enter the dwelling. The dwelling and any other improvements on the property are being conveyed in their present condition, and the Seller and Auction Company make no representations or warranties regarding their condition, structural integrity, habitability, utilities, systems, or future use.
The Buyer will accept the abandoned dwelling in its present condition and will assume responsibility for any future demolition, removal, disposal, permits, costs, or other requirements associated with the structure following closing.
Some miscellaneous debris and personal property may remain on the property at the time of closing. Any remaining items will be conveyed with the real estate in their present condition and will become the sole responsibility of the Buyer. Seller will not be responsible for the removal or disposal of any remaining debris or personal property.
Prospective buyers are encouraged to inspect the property and conduct any investigations they deem necessary prior to bidding; however, entry into the abandoned dwelling is prohibited.
11. ACREAGE
For purposes of the auction and calculation of the purchase price, 29 acres will be used as the acreage multiplier. The successful bid price per acre will be multiplied by 29 acres to determine the final bid amount.
The property is being sold based upon the stated 29-acre multiplier and not based upon a subsequent survey or measurement. No adjustment to the purchase price will be made based upon any subsequent determination of acreage.
12. PROPERTY BOUNDARIES

14. ZONING & PROPERTY USE

15. EASEMENTS & RESTRICTIONS

16. INSPECTION & DUE DILIGENCE
All inspections and due diligence must be completed prior to bidding. By placing a bid, the bidder acknowledges that they have inspected the property to their satisfaction or have elected not to do so and are relying upon their own investigation.
17. TITLE
Seller shall provide marketable title to the property, subject to permitted exceptions, easements, restrictions, rights-of-way, and other matters of record.
18. BIDDING
All bids are considered binding. The Auction Company reserves the right to establish bidding increments, resolve disputed bids, and correct any errors or technical issues that may occur during the auction.
The successful bidder will be required to enter into a Real Estate Purchase Agreement following Seller's acceptance of the final bid.
19. AGENCY
Backes Auctioneers & Real Estate represents the Seller exclusively in this transaction.
20. ANNOUNCEMENTS
Any announcements or modifications made by the Auction Company prior to the close of bidding shall take precedence over previously published or advertised information.
