Closing will take place approximately 30 days following the auction. Possession will be given at closing, and real estate taxes will be prorated to the date of closing.

    Septic inspection and any seller obligations resulting from the inspection will be handled in accordance with applicable Iowa law and requirements.

Terms & Conditions
  • 1. Property Description

    The real estate is located at 19461 and 19463 270th Street, Grundy Center, Iowa 50638, in rural Grundy County, Iowa.

    The property consists of two parcels containing approximately 2.44 combined acres, more or less, together with the residence and all other improvements located thereon.

    Both parcels will be offered and sold together as one property for one total purchase price. The property will not be offered or sold on a price-per-acre basis.

    2. Online Auction

    This is an online-only real estate auction. Online bidding is scheduled to close on Thursday, September 17, 2026 at 5:00 P.M., subject to the auction platform's applicable bidding and closing procedures.

    Bidders are responsible for registering and becoming familiar with the online bidding platform prior to the close of the auction.

    3. Seller Confirmation

    The property is being sold subject to Seller's approval of the final bid price.

    The highest bid shall not constitute a binding sale until the final bid price has been accepted by Seller. Seller reserves the right to accept or reject the final bid.

    4. Buyer's Premium & Earnest Money

    A ten percent (10%) Buyer's Premium will be added to the final bid price to determine the total purchase price.

    Upon Seller's acceptance of the final bid price, the successful Buyer shall pay an amount equal to the 10% Buyer's Premium, which shall be held as non-refundable earnest money and credited toward the total purchase price at closing.

    The remaining balance of the purchase price shall be due and payable in full at closing.

    5. Real Estate Purchase Agreement

    Following Seller's acceptance of the final bid price, the successful Buyer shall execute a written Real Estate Purchase Agreement incorporating these Terms & Conditions and any other applicable terms of the transaction.

    Buyer shall be prepared to promptly execute the Purchase Agreement and deliver the required earnest money following notification of Seller's acceptance.

    6. Closing

    Closing shall take place within thirty (30) days following the auction date, unless otherwise agreed to in writing by Buyer and Seller.

    The remaining balance of the purchase price shall be paid in full at closing.

    7. Possession

    Possession of the property shall be given to Buyer at closing, upon payment in full and completion of all required closing documents.

    8. Real Estate Taxes

    Real estate taxes shall be prorated to the date of closing. Buyer shall be responsible for real estate taxes attributable to the property following closing.

    9. Property Condition / AS IS, WHERE IS

    The property, including the residence, land, improvements, fixtures, mechanical systems, utilities, structures, and all other components of the real estate, is being sold "AS IS, WHERE IS," with all faults, subject only to Seller's obligations regarding the septic system as required by applicable law.

    The residence is in need of substantial remodeling, repair, and updating. Buyer acknowledges that Buyer has had, or has been provided, the opportunity to fully inspect and investigate the property prior to bidding.

    Buyer is purchasing the property based upon Buyer's own inspection, investigation, and judgment as to its condition and suitability.

    Seller and Backes Auctioneers & Realty make no representations or warranties, expressed or implied, regarding the condition of the residence, improvements, structural components, mechanical systems, utilities, or any other portion of the property, except as may otherwise be specifically provided in the Real Estate Purchase Agreement or required by law.

    Seller shall not be responsible for making repairs, replacements, improvements, or cleanup to the property prior to closing except for Seller's obligations concerning the septic system as required by applicable law.

    10. Septic System / Time of Transfer Inspection

    Seller shall obtain and pay for the required Iowa Time of Transfer septic system inspection prior to closing, as required by Iowa law.

    If the inspection determines that repairs, modifications, or replacement of the private sewage disposal system are required by Grundy County, the Iowa Department of Natural Resources, or other applicable governmental authority, Seller shall be responsible for completing the required work in accordance with applicable laws and regulations.

    Except for Seller's obligations relating to the septic system as required by law, Buyer acknowledges that the septic system is otherwise included in the sale in its existing condition.

    11. Personal Property & Debris

    The real estate is being sold in its current condition, including any personal property, contents, materials, debris, rubbish, or other items remaining on the premises.

    Seller shall have no obligation to remove, dispose of, clean up, or otherwise address any personal property or debris remaining on the property prior to closing.

    Buyer shall accept the property in its condition as of closing, including all remaining contents and debris, and shall be solely responsible for any removal, disposal, cleanup, or related expense following closing.

    Any personal property or other items remaining on the premises at the time of closing shall be deemed abandoned by Seller and shall become the responsibility of Buyer. No value is being attributed to any remaining personal property or contents as part of the real estate transaction.

    12. No Contingencies

    The sale is not contingent upon financing, appraisal, inspection, sale of another property, or any other Buyer contingency.

    Prospective Buyers are encouraged to complete all inspections, investigations, financing arrangements, and other due diligence prior to bidding.

    By placing a bid, Buyer acknowledges that Buyer has completed any desired due diligence and is financially prepared to complete the purchase according to these Terms & Conditions.

    13. Title & Deed

    Seller shall provide marketable title to the property in accordance with the terms of the Real Estate Purchase Agreement.

    Title evidence, deed, and the handling of any title objections shall be governed by the Real Estate Purchase Agreement and applicable Iowa law.

    14. Online Bidding Disclaimer

    Bidders acknowledge that online bidding is subject to internet connectivity, software performance, device limitations, and other factors outside the control of Seller and Auctioneer.

    Seller and Backes Auctioneers & Realty shall not be responsible for technical issues, internet interruptions, bidding delays, missed bids, equipment failures, or other problems resulting from a bidder's equipment, internet connection, or the online bidding platform.

    Bidders are encouraged to place bids sufficiently in advance of the scheduled closing time to reduce the risk of technical issues affecting their ability to bid.

    15. Bidding Procedure

    Auctioneer reserves the right to determine bidding increments and to resolve any bidding disputes or irregularities that may arise during the auction.

    Auctioneer's decision regarding the conduct of the auction and bidding process shall be final.

    16. Risk of Loss

    Risk of loss or damage to the real estate shall remain with Seller until closing and shall transfer to Buyer upon closing.

    17. Buyer Default

    If Buyer fails to complete the purchase according to the terms of the Real Estate Purchase Agreement, the earnest money shall be forfeited to Seller as provided in the Purchase Agreement.

    Seller shall retain any additional rights or remedies provided under the Real Estate Purchase Agreement or applicable law.

    18. Due Diligence

    All property information provided by Seller or Auctioneer is believed to be accurate but is not guaranteed.

    Prospective Buyers are responsible for conducting their own investigation and due diligence regarding the property, including but not limited to property boundaries, acreage, zoning, permitted uses, easements, utilities, structural condition, environmental conditions, and any other matter important to Buyer.

    Bidders should conduct all desired due diligence prior to placing a bid.

    19. Announcements & Disclaimer

    Any announcements, corrections, or modifications made by Auctioneer prior to the close of bidding shall take precedence over any prior advertising, printed materials, website information, or other representations.

    Information contained in advertisements, brochures, websites, maps, photographs, videos, property descriptions, or other promotional materials is believed to be accurate but is not guaranteed. Seller and Auctioneer assume no liability for errors, omissions, or inaccuracies.

    No expressed or implied warranties are made by Seller or Backes Auctioneers & Realty except as may be expressly stated in the Real Estate Purchase Agreement or required by applicable law.
