Terms and Conditions of Real Estate
• Method of Sale:
The properties shall be sold and conveyed by their full and accurate legal descriptions.
• Contract and Disclosures:
The successful Buyer and Seller shall execute a standard Real Estate Uniform Offer and Acceptance Agreement along with all required disclosure statements immediately following the auction.
• Earnest Money:
A non-refundable earnest deposit equal to ten percent (10%) of the purchase price shall be paid on the day of sale. Funds will be held in the Backes Realty Trust Account until closing.
• Closing:
The balance of the purchase price shall be due and payable in full on or before December 8, 2025.
• Title and Deed:
Seller shall furnish a merchantable abstract of title and provide a Warranty Deed at closing.
• Possession:
Possession of the property shall be granted to the Buyer upon successful completion of closing.
• Taxes:
Real estate taxes shall be prorated to the date of closing based upon the most current available tax information.
• Seller’s Confirmation:
All final bids are subject to Seller approval. The Seller reserves the right to accept or reject any and all bids.
• Property Condition:
Buyer acknowledges having had the opportunity to inspect the property and agrees to purchase it in “as is, where is” condition, with all faults, and without any warranties or guarantees, expressed or implied.
• Survey:
It will be the buyer’s responsibility and expense to have the property surveyed if the deem necessary.
• Financing:
This is a cash-only sale. Buyers must provide a current pre-approval letter or proof of funds from a recognized financial institution at the time the Offer and Acceptance is executed. A 10% buyers fee applies to final selling price.
• Assessment and Taxes:
The 2025 assessed valuation, as recorded with the Black Hawk County Assessor’s Office, is $98,950.00, with net annual real estate taxes of $1,076.56.
• Auction Close and Confirmation:
Upon conclusion of bidding and expiration of the auction time, the Auctioneer will contact the Seller to confirm whether the final bid amount is acceptable for sale approval.
